1. Acceptance of Terms

By accessing and using FSBO-MLS.com ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

FSBO-MLS.com provides an online platform that enables homeowners to list their properties for sale by owner (FSBO) and gain exposure through Multiple Listing Service (MLS) networks. Our services include:

• Property listing creation and management
• MLS syndication and distribution
• Lead generation and buyer inquiries
• Marketing tools and resources
• Customer support and guidance

3. User Accounts

3.1 Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

3.2 Account Types

We offer different account types including Buyer, Seller, and Agent accounts. Each account type has specific features and limitations as described in our pricing plans.

4. Property Listings

4.1 Listing Requirements

When creating a property listing, you agree to:

• Provide accurate and truthful information about the property
• Have legal authority to list the property
• Comply with all applicable fair housing laws
• Use only photographs and content you own or have permission to use
• Not include discriminatory language or preferences

4.2 Listing Content

You retain ownership of your listing content but grant FSBO-MLS.com a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of providing and promoting our services.

4.3 Listing Removal

We reserve the right to remove any listing that violates these terms, contains false information, or violates applicable laws.

5. Fees and Payment

5.1 Pricing

Our pricing plans are described on our Pricing page. Fees are subject to change with 30 days notice.

5.2 Payment Terms

• All fees are due at the time of purchase
• Payments are processed securely through our payment partners
• You authorize us to charge your payment method for all fees

5.3 Refunds

Refunds are provided according to our refund policy. Generally, fees are non-refundable once your listing is published to the MLS.

6. Prohibited Activities

You agree not to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Post false, misleading, or fraudulent content
• Harass, abuse, or harm other users
• Transmit viruses or malicious code
• Attempt to gain unauthorized access to our systems
• Use automated systems to access the Service
• Interfere with the proper functioning of the Service
• Collect user information without consent

7. Intellectual Property

The Service and its original content, features, and functionality are owned by FSBO-MLS.com and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Third-Party Services

Our Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party sites.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FSBO-MLS.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

11. Indemnification

You agree to indemnify and hold harmless FSBO-MLS.com and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.
